Welcome to PayService! These Terms of Service ("Terms") govern your access to and use of our service management platform. By creating an account and using our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our platform. If you do not agree to these Terms, you may not access or use our services.

1. Acceptance of Terms

By registering for an account, accessing, or using PayService, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and PayService.

2. Eligibility

To use our services, you must:

Be at least 18 years of age
Have the legal capacity to enter into binding contracts
Operate a legitimate business or service organization
Provide accurate and complete registration information
Comply with all applicable laws and regulations in Sri Lanka

3. Account Registration and Security

3.1 Account Creation

You must create an account to use PayService. You agree to provide accurate, current, and complete information during registration and to update this information to maintain its accuracy.

3.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Ensuring your password is strong and secure

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, illegal, or harmful activities.

4. Services Provided

PayService provides:

Service request management and tracking
Customer database and communication tools
SMS notification services for customer updates
Payment processing through integrated payment gateways
Wallet management for SMS credits
Invoice generation and financial reporting
Service history and analytics

5. User Responsibilities

You agree to:

Use the platform only for lawful business purposes
Provide accurate information about your services and customers
Comply with all applicable laws regarding SMS communications
Obtain necessary consent before sending SMS notifications to customers
Maintain adequate wallet balance for SMS services
Not use the platform for spam, harassment, or fraudulent activities
Respect intellectual property rights
Not attempt to breach security or interfere with platform operations

6. Payment Terms

6.1 Wallet System

Our platform operates on a prepaid wallet system. You must maintain sufficient balance for SMS services. Each SMS costs LKR 5.00.

6.2 Payment Processing

Payments are processed through PayHere, our third-party payment gateway. A 3.3% processing fee applies to all wallet top-ups. All transactions are in Sri Lankan Rupees (LKR).

6.3 Welcome Bonus

New accounts receive a one-time LKR 2,000 welcome bonus. This bonus is non-refundable and can only be used for SMS services on our platform.

6.4 Refund Policy

Wallet top-ups are generally non-refundable. Refund requests may be considered on a case-by-case basis for technical errors or unauthorized transactions. Contact support within 7 days of the transaction.

7. SMS Notification Services

Regarding SMS services:

SMS delivery rates depend on carrier networks and are not guaranteed
You are responsible for obtaining customer consent for SMS communications
SMS costs are deducted from your wallet balance automatically
We reserve the right to monitor and restrict SMS usage to prevent abuse
Bulk SMS or spam activities are strictly prohibited
SMS content must comply with Sri Lankan telecommunications regulations

8. Intellectual Property

All content, features, and functionality of PayService (including but not limited to software, text, graphics, logos, and design) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your business data and customer information. By using our platform, you grant us a limited license to use, store, and process this data solely to provide our services to you.

9. Prohibited Activities

You may not:

Violate any laws or regulations
Infringe on intellectual property rights
Transmit malware, viruses, or harmful code
Attempt unauthorized access to our systems
Reverse engineer or decompile our software
Use automated systems (bots, scrapers) without permission
Resell or redistribute our services without authorization
Send spam or unsolicited communications
Impersonate others or provide false information
Engage in fraudulent activities or money laundering

10. Data Protection and Privacy

We are committed to protecting your data. Our data practices are detailed in our Privacy Policy. By using our services, you consent to our collection, use, and disclosure of information as described in the Privacy Policy.

11. Service Availability and Modifications

We strive to provide uninterrupted service but do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

We may perform scheduled maintenance that temporarily restricts access. We will provide advance notice when possible.

12. Disclaimers and Limitations of Liability

12.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.

12.2 Limitation of Liability

To the maximum extent permitted by law, PayService shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services.

12.3 Third-Party Services

We are not responsible for the actions, content, or services of third-party providers (payment gateways, SMS carriers, etc.).

13. Indemnification

You agree to indemnify and hold harmless PayService, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any rights of others.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

16. Termination

You may terminate your account at any time by contacting support. We may terminate or suspend your account immediately, without notice, for:

Violation of these Terms
Fraudulent or illegal activities
Extended periods of inactivity
Non-payment or chargebacks

Upon termination, your access to services will cease, but certain obligations (payment, indemnification) will survive.

18. Severability
